1. Agreement to Terms

By accessing or using the extraFit mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the App.

2. Description of Service

extraFit is a fitness tracking application that provides:

• Workout tracking and guided exercise routines
• Step counting and daily activity monitoring
• Nutrition and water intake logging
• Social features to connect with workout buddies
• Progress analytics and personalized insights
• Video demonstrations of exercises

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account
• You must be at least 13 years old to use this App

3.2 Account Types

• Free Account: Access to basic fitness tracking features
• Premium Account: Additional features including advanced analytics, custom workouts, and more

3.3 Account Security

• Notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage from unauthorized account access
• Email verification is required to use social features (workout buddies)

4. User Conduct

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Activities

You may NOT:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App or servers
• Transmit viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Create fake accounts or impersonate others
• Scrape or data mine user information
• Reverse engineer or decompile the App
• Use the App to spam or send unsolicited messages
• Share inappropriate content with workout buddies

4.3 Content Sharing

• When sharing activities with workout buddies, ensure content is appropriate
• Do not share false or misleading health information
• Respect other users' privacy and boundaries

5. Intellectual Property

5.1 App Ownership

• The App and its original content, features, and functionality are owned by extraFit
• The App is protected by copyright, trademark, and other intellectual property laws

5.2 Your Content

• You retain ownership of any content you create (workout logs, notes, etc.)
• By using the App, you grant us a license to use your content to provide the service
• We will not share your personal workout data publicly without your consent

5.3 Third-Party Content

• Exercise demonstration videos are embedded from YouTube
• You agree to comply with YouTube's Terms of Service when viewing videos
• We do not claim ownership of third-party content

6. Health and Safety Disclaimer

6.2 User Responsibility

• You assume all risks associated with exercise
• Stop exercising immediately if you feel pain or discomfort
• Listen to your body and exercise within your limits
• The App's recommendations are suggestions, not prescriptions

6.3 No Warranties

• We make no warranties about the accuracy of fitness calculations
• Step counts, calorie estimates, and other metrics are approximations
• Results vary by individual and are not guaranteed

7. Subscriptions and Payments

7.1 Free Trial

• New users receive a free trial period (as specified in the App)
• Trial automatically converts to paid subscription unless cancelled
• Cancel anytime during trial to avoid charges

7.2 Premium Subscription

• Subscription fees charged according to selected plan
• Payments processed through Apple App Store or Google Play Store
• Pricing displayed before purchase
• Subscriptions auto-renew unless cancelled

7.3 Cancellation and Refunds

• Cancel subscription anytime through App Store or Play Store settings
• Cancellation effective at end of current billing period
• No refunds for partial months or unused time
• Refunds subject to App Store / Play Store policies

7.4 Price Changes

• We reserve the right to change subscription prices
• You will be notified of price changes in advance
• Continued use after price change constitutes acceptance

8. Termination

8.1 Termination by You

• You may delete your account at any time through the App
• Account deletion is permanent and cannot be undone
• All your data will be deleted within 30 days

8.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees
• Remain inactive for an extended period

8.3 Effect of Termination

• You lose access to all App features immediately
• We will delete your data according to our Privacy Policy
• Paid subscriptions are not refunded upon termination

9. Privacy

Your use of the App is also governed by our Privacy Policy.

• You can export or delete your data anytime

10. Workout Buddy Features

10.1 Social Interactions

• Workout buddy features allow you to connect with other users

• Email verification required to send/receive buddy requests
• You can remove buddies at any time
• We are not responsible for conflicts between users

10.3 Shared Content

• Activities shared with buddies are visible to them only
• We may moderate content if reports of abuse are received
• Inappropriate content may result in account suspension

11. Third-Party Services

11.1 Integrations

The App integrates with:

• Apple Health (iOS) for step tracking
• Google Fit (Android) for step tracking
• YouTube for exercise videos
• Stripe for payment processing

11.2 Third-Party Terms

• Each third-party service has its own terms and privacy policy
• We are not responsible for third-party services
• Integration may be discontinued at any time

12. Limitation of Liability

12.1 No Liability for Injuries

• We are not liable for any injuries or health issues from using the App
• Exercise carries inherent risks
• Always consult a doctor before starting an exercise program

12.2 Service Availability

• We strive for 99% uptime but cannot guarantee uninterrupted service
• We are not liable for service interruptions or data loss
• Regular backups are performed but are not guaranteed

12.3 Maximum Liability

• Our total liability to you is limited to the amount you paid us in the last 12 months
• We are not liable for indirect, incidental, or consequential damages

13. Indemnification

You agree to indemnify and hold harmless extraFit from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your exercise activities or health outcomes

14. Disclaimers

14.1 "As Is" Service

• The App is provided "as is" without warranties of any kind
• We do not warrant that the App will be error-free or secure
• We do not warrant the accuracy of fitness data or calculations

14.2 No Professional Advice

• The App does not provide medical, nutritional, or professional advice
• All information is for general educational purposes only
• Consult professionals for personalized advice

15. Changes to Terms

We may modify these Terms at any time. Changes will be effective:

• Immediately for new users
• After notice period for existing users (typically 30 days)

Continued use after changes means you accept the new Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

17. Dispute Resolution

17.1 Informal Resolution

• We will attempt to resolve issues within 30 days

17.2 Arbitration

• Disputes not resolved informally may proceed to arbitration
• Arbitration will be conducted in English
• Each party bears its own costs

• You waive the right to participate in class action lawsuits

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

19. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and extraFit regarding the App.

21. App Store Policies

21.1 Apple App Store

• If downloaded from Apple App Store, you acknowledge Apple's Licensed Application End User License Agreement

• Google is not responsible for the App or any claims related to it

22. Special Provisions

22.1 UK Users

• These Terms are compliant with UK Consumer Rights Act 2015
• Nothing in these Terms affects your statutory rights

22.2 EU Users (GDPR)

• You may withdraw consent for data processing at any time
• You may lodge complaints with your data protection authority

23. Copyright Infringement
